Harvey Weinstein's new rape trial in New York ended in a mistrial, the equivalent of a mistrial, after the jury failed to reach a unanimous verdict. The jurors had been deliberating for several days on the rape accusation brought by Jessica Mann, a former actress and hairstylist who accuses the ex-producer of assaulting her in a New York hotel in 2013.
The judge officially acknowledged the jury's impasse on Friday after several reports of deadlock in the deliberations. According to several American media outlets, the jurors were deeply divided over the credibility of the testimonies and the legal classification of the charges against Harvey Weinstein.
A central issue in the #MeToo movement
This proceeding constituted the third New York trial related to the accusations against Harvey Weinstein. His landmark conviction in 2020 was overturned on appeal in 2024 on procedural grounds, paving the way for a new trial.
The prosecution argued that Weinstein had used his immense influence in the Hollywood industry to manipulate and assault several women. The defense, on the other hand, maintained that the relationship with Jessica Mann was consensual and complex, relying in particular on exchanges of messages and continued contact after the alleged incidents.
Weinstein remains behind bars despite this legal setback
Aged 74 and now regularly appearing in a wheelchair for health reasons, Harvey Weinstein nevertheless remains in custody due to his other convictions for sexual assault and rape in California as well as another New York conviction already handed down in a previous legal case.
Manhattan District Attorney Alvin Bragg stated that the prosecution would discuss the next steps in the case with Jessica Mann, leaving open the possibility of a fourth trial. For her part, the accuser asserted after the court's decision that the lack of a verdict "did not change the truth" of her testimony.
