These analyses reportedly found Luc Besson's DNA on an item of underwear belonging to the complainant. This element is presented as new in a case that had previously been dismissed.

DNA expertise at the heart of the procedure

The expert analysis concerns an undergarment that Sand Van Roy claims to have worn at the time of the alleged events. The analyses were reportedly carried out by a Dutch laboratory. The plaintiff's defense argues that this analysis was not properly conducted previously and that it may justify reopening the investigation.

Sand Van Roy accuses Luc Besson of rape, which allegedly took place in 2018 in a Parisian luxury hotel. She describes a relationship marked, according to her, by a situation of control. Luc Besson acknowledges having had an extramarital affair with the actress but denies any rape allegation. He maintains that the relationship was consensual.

A dismissal has already been issued.

The case had already been examined by the courts. After several years of proceedings, the filmmaker was cleared of all charges. This decision was subsequently upheld. The current request from the public prosecutor's office therefore aims to determine whether the new DNA evidence is sufficiently compelling to reopen the investigation.

Decision expected on June 2nd

The investigating chamber is scheduled to meet on June 2nd to examine the request for reopening the case. It will have to decide whether the investigation should be relaunched or if the dismissal remains valid. At this stage, the reopening is therefore not yet a done deal. Luc Besson remains presumed innocent.
