The Council of State has rejected the final appeals filed by associations opposed to the A69 motorway between Toulouse and Castres. The highest administrative court upheld the ruling issued on December 30, 2025, by the Toulouse Administrative Court of Appeal, which had validated the environmental permits granted by the State in 2023. This decision brings to a close the administrative litigation concerning the legality of the project, which has been highly contested since its inception due to its environmental impact. The environmental permits are now final.
A recognized reason of major public interest
The Council of State ruled that the project serves an overriding public interest. The judges cited several arguments: time savings for users, improved quality of life, economic development of the region, and road safety. The highest court determined that the administrative court of appeal had not erred in law in upholding these justifications. The project includes the construction of the A69 motorway and the widening of the A680.
This decision concerns only the legality of the administrative permits. A separate legal dispute regarding the execution of the work by the company remains pending before the Toulouse Judicial Court. The opponents had already lost their initial case before the Toulouse Administrative Court on February 27, 2025, before their appeal was also rejected at the end of the year. The construction can now proceed without any legal obstacles from an environmental standpoint.
