Elon Musk faces French justice, insulting X in response

On Friday, May 8, Elon Musk chose confrontation. On X, the head of the social network posted an insulting message targeting French magistrates, using vulgar language and homophobic remarks written in French, as if to rub salt in the wound. The tactic is familiar, as is the style: attack the justice system in the public arena, create a stir, shift the debate. However, this time, the context is far from a simple heated exchange in a discussion thread.

An investigation dating back to January and a tone that's gone too far.

On Thursday, the Paris prosecutor's office announced that an investigating judge has been assigned to a case concerning possible complicity in the distribution of child pornography on the platform. The investigation, opened in January 2025, targets Elon Musk and the former CEO of X, Linda Yaccarino, in her capacity as de facto and de jure manager at the time of the alleged offenses. According to Franceinfo, a summons for a voluntary interview had been sent to the American billionaire a few days before the announcement, but he did not respond. In mid-February, a search was conducted at X's Paris offices, and Musk had already lashed out at the magistrates, notably calling them "mentally retarded."

At its core, the investigation, entrusted to the gendarmerie's national cyber unit, focuses on X's obligations in France and potential violations of applicable national legislation. The case also raises the issue of the use of Grok, X's artificial intelligence model, in the creation of hyper-realistic sexually explicit images produced without the victims' consent. Following the search, X denounced an "abusive judicial act" based on "political motives" and asserted that it denied any wrongdoing. Between the escalating legal proceedings and the inflammatory rhetoric, one thing is already clear: the relationship between the platform and the French rule of law is becoming increasingly complex, with the next chapter likely to unfold through actions rather than tweets.
