Pro-Palestinian activist Mahmoud Khalil, a graduate of Columbia University, announced his intention to appeal to the United States Supreme Court after a court decision that opens the door to possible re-arrest and deportation by US authorities.
This announcement comes after a federal appeals court refused to review a previous ruling in Khalil's favor. The court, the 3rd Circuit Court of Appeals based in Philadelphia, was deeply divided, with the decision adopted by a 6-5 vote along ideological lines.
The judges ruled that the lower court magistrate lacked jurisdiction when he ordered Khalil's release from a migrant detention center last year. This decision therefore undermines the legal protection the activist had previously enjoyed.
Mahmoud Khalil's lawyers denounce a decision they deem "dangerous." According to them, it could allow for prolonged detention without genuine judicial oversight, as well as the political exploitation of migration procedures against activists.
The case stems from Khalil's pro-Palestinian mobilization efforts on American university campuses, particularly at Columbia. He was among the most prominent international students arrested last year as part of the president's administration's immigration policy. Donald Trump.
In this context, the immigration court had already ordered his deportation to Algeria or Syria, a decision his lawyers are also contesting. An appeals board rejected his appeal in April, increasing the legal pressure against him.
If the appeals court's decision is implemented, Mahmoud Khalil could be arrested and deported again. His legal team now intends to take the case to the Supreme Court to challenge what it considers a violation of his constitutional rights and the judicial oversight of administrative decisions.
