The Douai Administrative Court of Appeal overturned the ruling that had reinstated the partnership agreement between the French state and the Lycée Averroès, the main Muslim school in France. The judges ruled that the school's legal action was inadmissible because it had not been preceded by the mandatory administrative appeal to the prefect.
This decision does not address the merits of the case but solely a procedural flaw. In April 2025, the Lille Administrative Court had reinstated the partnership agreement, ruling that the administration had not demonstrated sufficiently serious breaches to justify its termination.
A new appeal has already been announced.
The contract was terminated by the Nord prefecture in December 2023, which accused the institution of serious breaches of the fundamental principles of the Republic. This termination led to the suspension of public funding intended to pay the teachers.
The school's lawyer announced that a new appeal would be filed to preserve the partnership agreement before the start of the next academic year. The school administration, which serves approximately 800 students, hopes to maintain its current operations while awaiting a new ruling on the merits of the case.
