Sanofi targeted by an EU investigation for suspected competition infringement

The European Commission has opened a formal investigation against the French pharmaceutical company Sanofi, suspected of abusing its dominant position in the flu vaccine market. The group is accused of conducting a smear campaign against a competing vaccine targeting healthcare professionals.

Suspicions of a deceptive campaign

Following raids conducted last year, the European Commission believes that Sanofi presented the Fluad vaccine, marketed by the Australian group CSL Seqirus, as inferior to its own Efluelda vaccine. According to the Commission, this communication was misleading and contrary to vaccination recommendations in force in several Member States, notably France and Germany. The investigation concerns a possible abuse of a dominant market position, which could distort competition in the flu vaccine market.

Sanofi denies the accusations

When contacted by AFP, Sanofi stated that it has always acted in compliance with competition law. The company emphasized that the initiation of formal proceedings does not prejudge the outcome and reaffirmed its commitment to fair competition and patient access to innovative vaccines. If the allegations are confirmed, the European Commission could impose a fine on the pharmaceutical company. Sanofi also has the opportunity to propose commitments to address Brussels' concerns during the proceedings.
